1. Acceptance of terms

By using Emaki ("the Service", "we", "us"), creating an account or making a purchase, you agree to these Terms & Conditions. If you do not agree, do not use the Service. Emaki is operated by Dzeal Private Limited, India.

2. Eligibility

You must be at least 18 years old to create an account or buy credits. Younger users may use the free tool only with the involvement of a parent, guardian or teacher.

3. The Service

Emaki creates MP4 videos from images you select, with optional captions, motion, transitions, an animated cursor and AI-generated narration. Videos are made inside your browser; your images are not uploaded to us. Narration with cloud voices is created on our servers from the text you provide.

4. Content rules

You are responsible for everything you put into Emaki and for how you use the videos you make. You must not use Emaki to create content that includes, in images, captions or narration:

• Abusive or hateful language: slurs, obscenities, or content that attacks or demeans people for their race, caste, religion, ethnicity, nationality, gender, sexual orientation, disability or similar characteristics.
• Political targeting: content that attacks, ridicules, threatens or spreads false claims about political parties, leaders, candidates or public officials.
• Harassment and threats against any person or group, or content that promotes violence, self-harm or terrorism.
• Nudity or sexual content of any kind. Any sexual content involving minors is absolutely prohibited and will be reported to the authorities.
• Morphed or manipulated images of real people, deepfakes, or impersonation of any real person, including making it appear that a real person said or did something they did not.
• Misinformation presented as real news, events or official communication.
• Private information of others, or images of people used without the rights or consent you need.
• Content that infringes anyone's copyright, trademark or other rights, or that is otherwise unlawful under Indian law.

To help enforce these rules, Emaki uses automated checks. Narration text is checked before audio is created, and images may be checked by a model running in your browser. A check may block a video from being made. Automated checks are not perfect; they do not make us responsible for your content, and passing them does not mean content is allowed.

We may suspend or close accounts that break these rules, without refund of credits, and we cooperate with lawful requests from authorities.

5. AI-generated narration

• Emaki's voices are synthetic, computer-generated voices. Emaki does not offer voice cloning, and the voices do not belong to any real person.
• Videos with AI narration carry a disclosure and embedded information identifying them as created with Emaki, as required under Indian law for synthetically generated content. You must not remove, hide or alter these labels or identifiers.
• You must not present Emaki narration as the voice of a real person, or use it to deceive anyone.

6. Accounts

• Keep your login details confidential. You are responsible for all activity under your account.
• Give accurate information, including a valid email address, which is used for verification, account recovery, purchase confirmations and account deletion.
• Tell us promptly about any unauthorised use of your account.
• Narration requires an account with a confirmed email address. Silent videos can be made without an account.
• Each exported video is recorded (export ID, time, IP address and basic settings, but not the video) and, if you are signed in, linked to your account, as described in our Privacy Policy.

7. Your content and videos

• You keep all rights to your images, text and the videos you make.
• For cloud voices, you give us a limited licence to process your narration text only to create the audio. We do not keep the text and do not use it to train AI.
• You confirm you have all the rights and permissions needed for the content you use.
• Free videos include a "Made with Emaki" watermark and QR code. You must not remove them except by making a paid export.

8. Credits and plans

• Credits are consumed as described on our Plans page, which forms part of these Terms. Emaki shows the credits needed before each video is made.
• Credits are valid for 3 months (90 days) from purchase. Unused credits expire and are not refunded.
• Each purchase is a separate pack starting on its own purchase date. Credits from the pack expiring soonest are used first.
• Credits have no cash value and cannot be transferred, sold or exchanged for cash.
• You see no ads for 90 days after each purchase.
• We may change pricing and credit rules for future purchases, with notice on the Plans page. Changes do not affect credits already bought.

9. Payments and taxes

• Payments are processed by Razorpay. We do not store your card or bank details.
• Prices are in Indian rupees (INR) for customers billed in India and US dollars (USD) elsewhere, based on the billing country you give. Indian prices include GST.
• Where Razorpay adds a convenience fee, it is shown before you pay, is payable by you and is not refundable, except as described in our Refund & Cancellation Policy.
• Bank, card or currency conversion charges are payable by you.
• Invoices are downloadable from your account and are not emailed.
• Purchases are non-refundable once activated, except as set out in our Refund & Cancellation Policy.

10. Acceptable use of the Service

You must not attempt to bypass the credit system, watermark, content checks or security of the Service; access another user's account; overload or disrupt the Service; or copy, scrape or resell the Service.

11. Intellectual property

The Service, including its software, design and branding, belongs to us or our licensors. Open-source components are used under their own licences. Nothing in these Terms gives you rights to our intellectual property beyond using the Service as intended.

12. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind. We do not guarantee that it will be uninterrupted, error-free, or that videos will meet your expectations or play on every device or platform. See our Disclaimer.

13. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or loss of profits, data or goodwill. Our total liability for any claim is limited to the amount you paid us in the three (3) months before the claim.

14. Indemnity

You agree to indemnify us against claims, damages and expenses (including reasonable legal fees) arising from your content, your videos, your use of the Service, or your breach of these Terms.

15. Suspension and termination

We may suspend or close your access for breach of these Terms. You may close your account at any time from your account page. Closing an account does not entitle you to a refund of unused credits.

16. Discontinuation

If we decide to discontinue Emaki, we will give at least 30 days' notice by email and on the site, stop new purchases from the date of notice, and keep the Service running until all packs bought before the notice have expired. If the Service must end earlier, we will refund unused paid credits pro rata to the original payment method.

17. Changes to these Terms

We may update these Terms. Material changes will be shown by updating the "Last updated" date. Continued use after changes means you accept them.

18. Governing law

These Terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts in Mumbai, India.

19. Severability and entire agreement

If any provision is unenforceable, the rest remain in effect. These Terms, with our Privacy Policy, Plans, Refund & Cancellation Policy and Disclaimer, are the entire agreement between you and us.
